POSSESSION

While on patrol in the area of Plainfield Street on April 6 at approximately 5:15 p.m., Lieutenant Joseph Salvadore observed a driver that was not wearing a seatbelt. A traffic stop was initiated at the intersection of Atwood and Morgan Avenues, where contact was made with the driver, who was identified as Dylon Gibau, 24, of 4 Parker Street in Central Falls.

While speaking with Gibau, the officer reported that he smelled a strong odor of marijuana emanating from the interior of the vehicle. Lt. Salvadore asked Gibau if there was any marijuana in the car and if he is a medical marijuana patient or a caregiver.

According to the report, Gibau said there was marijuana in the vehicle and that he does not possess a medical marijuana card. He was removed from the car and then pointed to a brown shoe box in the back seat. The box was removed and inside was a black plastic bag containing a significant amount of what appeared to be marijuana that was estimated to weigh more than an ounce. A field test of the substance proved positive for marijuana.

Gibau was then placed under arrest without incident and advised of his rights. He then allegedly confirmed that the marijuana was his and that his passenger had no involvement. A search of the vehicle did not produce any additional narcotics or weapons, and the car was driven away by a licensed operator. Gibeau was then transported to police headquarters where he was processed and charged with misdemeanor possession of marijuana, first offense, with a Third District Court summons to appear. He was issued a verbal warning for the motor vehicle violation.

SUSPENDED LICENSE

Captain Richard Norato was on duty traveling south on Atwood Avenue on April 19 around 12:30 p.m. when he observed a maroon Lexus traveling north in the center turn lane at the entrance of 11 Commerce Way with no turn signal activated.

As Captain Norato traveled past the vehicle the male driver raised his middle finger at the officer and then proceeded to turn left into the plaza parking lot. Captain Norato then followed the vehicle into the lot and conducted a traffic stop in front of Market Fine Wine and Spirits.

Contact was then made with the driver, Vincent Smith, 56, of 1537 Chalkstone Avenue in Providence. Smith was advised of the turn signal violation and questioned about his hand gesture. Checks of his license revealed that Smith’s license was suspended and his vehicles registration had been cancelled in October 2015. The vehicle’s inspection sticker displayed on the windshield was dated February 2019, however it did not match the vehicle it was attached to.

When informed of the status of his license and registration and that his vehicle would require a tow, Smith reportedly became contentious and uncooperative. Captain Norato requested that Smith remove any personal items he wished to retain from the vehicle, however he refused and stated that he would have his vehicle back on the road within an hour.

A Third District Court notice to appear was issued to Smith for driving on a suspended license and he was given a warning on all remaining violations. His vehicle was towed and Smith was provided a ride to the tow facility by the tow truck driver.

WARRANT

According to Lieutenant Troy Maddocks’ report, patrol units were dispatched to Amana Drive on April 17 at approximately 7:18 p.m. for a report of suspicious activity at an apartment. It was reported that a landlord was in the process of evicting a tenant and that two unknown females had shown up at the apartment and possibly entered it.

Sargent Luca Lancelloti and Lieutenant Maddocks were responding to the location when dispatch advised that the red SUV the women were operating had departed Amana Drive and were last observed traveling on Traver Avenue towards Greenville Avenue. Once in the area, the officers observed a red Jeep Liberty stopped at a red light on Traver Avenue waiting to turn onto Manton Avenue. Officers noted that the car did not have a front license plate and the headlights were not illuminated as required at the time.

The vehicle was then detained and the occupants were advised of the reasons why they were stopped. All occupants appeared confused, stating they were never on Amana Drive.

Patrol units relayed to Lieutenant Maddocks that the tenant of Amana Drive had until June 1 to vacate the apartment. A check of the apartment did not show any signs of forced entry or malicious mischief. Background checks on passenger Elijah Harrell, 21, of 360 Killingly Street in Providence revealed a Sixth District Court bench warrant for failure to appear. He was taken into custody, transported to headquarters and processed. The driver was issued a verbal warning about using headlights when required.
