Firearms charges

Patrolman Kevin Brady reports detaining a vehicle in the area of 2 Greenville Ave. on the night of Dec. 31 after he observed it passing his location with no front license plate attached.

Brady reports running checks on both the driver and passenger. As he did so, he states he witnessed both occupants appear to reach in the back seat twice and then reach toward the center console. The patrolman called for backup, and pat-down searches of the two occupants were conducted.

A search of the driver produced no weapons or contraband, according to Brady, but the passenger was found to be in possession of black “brass knuckles.” The passenger, whose name is redacted in a narrative report provided by police, was placed under arrest and charged with possession of weapons other than firearms.

A further search of the vehicle’s interior uncovered a silver and black Springfield Armory 9mm firearm, with four rounds of ammunition in its magazine but none in the chamber. A check revealed the weapon had been reported stolen out of Orlando, Fla.

The driver, Patthanapongsa Mongkolsombat, 20, of 434 Hartford Ave., Apt. 2, in Providence, was arrested and charged with possession of a stolen firearm and carrying a pistol without a license or permit. Both are felony charges. He was arraigned an ordered held on $3,500 surety bail.

DUI charge

Patrolman Andrew J. Broccoli reports responding to the area of 1123 Atwood Ave. just before 7 p.m. on Dec. 18 for a report of a motor vehicle accident with injuries.

Upon arrival, Broccoli reports the driver of one vehicle was receiving medical attention after complaining of chest pains. The operator told the patrolman she had been driving north on Atwood when a vehicle driving in the opposite direction in the same lane collided with hers head-on. She was transported to Rhode Island Hospital for further evaluation.

The operator of the second vehicle was uninjured and did not seek medical attention, Broccoli reports. The man reportedly told the patrolman he did not remember what caused the accident.

An independent witness at the scene corroborated the first operator’s account, according to the patrolman.

Broccoli reports that in speaking with the driver of the second vehicle, he “observed that his speech was slowed/slurred and his eyes were bloodshot and watery.” The patrolman also detected an odor of alcohol emanating from the man’s breath, and reports the man at one point stumbled while going to his vehicle to gather registration information.

The operator reportedly acknowledged consuming “one or two beers a couple of hours ago,” according to Broccoli’s report, and then consented to field sobriety testing, which he failed.

David K. Erikson, 61, of 3 Scenic Road in Johnston, was arrested on a misdemeanor charge of operating under the influence of drugs or alcohol (first offense, blood alcohol level unknown). He was transported to Johnston police headquarters, where he reportedly refused to submit to a breathalyzer test. He was additionally issued a citation for refusal to submit to a chemical test.

Obstruction charge

Lt. Seth D. Crosby reports traveling south on Atwood Avenue shortly after 5 p.m. on Dec. 24 when he observed a vehicle with Rhode Island registration cross the center line and proceed south in the northbound lane, passing several vehicles.

Crosby detained the vehicle in the Burlington Coat Factory parking lot, and reports he “could smell a strong odor of marijuana coming from the vehicle” as he approached. When questioned about the odor, the operator reportedly provided a small bag containing a green, leafy substance and acknowledged having a small amount of marijuana.

A records check on the operator found 21 prior charges related to narcotics, Crosby reports, and revealed the man was on probation for narcotics offenses.

Crosby reports he then asked the man to exit the vehicle. During the course of speaking with the operator, the lieutenant reports he observed the man appearing to conceal something in his mouth.

Crosby then asked the man to open his mouth, and reportedly noticed something hidden under his tongue. The lieutenant states he asked the man to lift his tongue, at which point the man reportedly “flipped” the item and curled it back toward the rear of his mouth.

“It was at that moment that I observed another plastic baggy containing a white substance in his mouth,” Crosby writes. “I immediately grabbed his lower jaw bone and told him to spit it out, however he swallowed the bag.”

Marvin E. Rogers, 46, of 99 Post Road, Apt. 24, in Warwick, was arrested and charged with a misdemeanor count of obstructing an officer in execution of duty. He was also issued a summons for possession of one ounce or less of marijuana.

Rogers was taken to Fatima Hospital for evaluation. He was arraigned before a justice of the peace at the hospital and released on $2,500 personal recognizance, and advised to continue treatment and observation at the hospital.

Heroin charge

Patrolman David J. Loffler reports conducting a business check shortly before 3 p.m. on Dec. 18 when he observed a male party who he knew to be wanted on a Rhode Island Superior Court warrant.

The man acknowledged the warrant and was taken into custody without incident, Loffler reports. A search of his person revealed two small plastic bags in his wallet, each of which contained a tan, powdery substance believed to be heroin.

According to the patrolman’s report, the man acknowledged it was heroin, and that he had purchased it earlier that day. Testing later confirmed the substance was heroin weighing a total of 1.11 grams, the report states.

Louis G. Cascella, 26, of 328 Waterman Ave., Apt. B, in Smithfield, is charged with a felony count of possession of a Schedule I substance (heroin). He was arraigned before a justice of the peace and ordered held on $10,000 surety bail.
