DUI CHARGE

Patrolman Arthur Petteruti reports responding to the area of 1800 Hartford Ave. at approximately 4:30 p.m. on Aug. 29 to assist another officer at the scene of a motor vehicle accident.

Petteruti spoke with one of the operators involved, and reports detecting a “strong odor of an alcoholic beverage” on the man’s breath.

The man also had “bloodshot watery eyes, his speech was slurred, and his face was red in color,” the patrolman reports. The man reportedly denied he had been drinking.

Petteruti reports he then observed two Bud Light Premium beer bottles on the vehicle’s front passenger-side floorboard, one being approximately a quarter full and the other being unopened. At that point, the patrolman asked the driver to submit to a series of field sobriety tests, to which he consented. The driver reportedly failed those tests, and then refused to submit to a preliminary breath test.

He was placed under arrest and transported to Johnston police headquarters, where he consented to a chemical breath test. That resulted in blood alcohol content readings of .258 and .239, Petteruti reports.

Max N. Wallerstein, 21, of 1009 Kettletown Road in Southbury, Conn., was charged with driving under the influence of drugs or alcohol (first offense, .15 or greater). He was also issued citations for presence of alcoholic beverages while operating, and refusal to submit to a preliminary breath test. He was released on $2,000 personal recognizance bail following his arraignment before a justice of the peace.

DISTURBANCE

Patrolman Derrick Palazzo reports he and two other officers responded to a disturbance in progress at approximately 1:20 a.m. on Aug. 29.

Upon arrival, Palazzo reports observing a large crowd of people pushing one another behind a residence. Once the disturbance was quelled, the patrolman spoke with a woman who indicated she and several friends had gone to a nightclub in Pawtucket that evening.

She told police that upon arriving at the location of the disturbance, she became involved in an argument with another woman, which progressed into a fistfight. She told police the other woman had “punched her in the face numerous times, as well as pepper sprayed her” in the eyes. Palazzo reports the woman’s eyes did appear to be bloodshot, red, and watery, which is consistent with exposure to pepper spray.

Palazzo reports he then sought to speak with the other woman, who was “extremely belligerent and continue to yell and scream profanities.” The woman reportedly refused to calm down and had to be physically restrained, and was then informed she was being placed under arrest.

Palazzo reports the woman refused to put her hands behind her back, and when he attempted to restrain her to apply handcuffs, she “spun 180 degrees and slapped me in the right side of my face with her left hand.” The patrolman reports he pinned the woman between his vehicle and himself in an effort to restrain her, and she “continued to struggle, trapping her hands between her stomach and my patrol vehicle, not allowing me to place her in handcuffs.” She was eventually placed under arrest and transported to Johnston police headquarters.

Danielle R. Dextradeur, 22, of 175 Japonica St., Apt. 2, in Pawtucket, was charged with two counts of simple assault or battery, disorderly conduct, and resisting arrest. She was released on $5,000 personal recognizance bail after her arraignment before a justice of the peace.
